Mye Health, Inc. (“Mye Health,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you use the Mye Health concussion hotline, website, patient portal, text messaging services, intake forms, video visits, scheduling tools, and related services (collectively, the “Services”).

If you are experiencing a medical emergency, call 911 immediately. The Mye Health concussion hotline and related Services are not a substitute for emergency medical care.

1. Information We Collect
We may collect information that you provide directly to us, information generated through your use of our Services, and information provided by caregivers, clinicians, clinics, athletic trainers, or other authorized care team members.

This information may include:

Name, date of birth, phone number, email address, address, and other contact information;
Parent, guardian, caregiver, or emergency contact information;
Insurance information, when needed for scheduling, referral, billing, or care coordination;
Information about a head injury, concussion symptoms, red flags, medical history, medications, allergies, prior concussions, and related health concerns;
Intake form responses, consent forms, appointment information, visit summaries, care recommendations, and follow-up instructions;
Text message history, call history, voicemail information, and communication preferences;
Video visit scheduling and participation information;
Technical information such as device type, browser type, IP address, pages visited, date and time of access, and usage logs;
Any other information you choose to provide through the Services.
Some of this information may be considered protected health information (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”) when Mye Health is acting for or on behalf of a healthcare provider, clinic, health plan, or another HIPAA-regulated organization.

2. How We Use Information
We use information to provide, operate, improve, and support the Services, including to:

Respond to hotline calls and patient inquiries;
Conduct administrative intake;
Send secure links to intake forms, consent forms, screening forms, appointments, video visits, and patient portal tasks;
Support concussion red-flag screening, care coordination, scheduling, and follow-up;
Communicate with you, your caregiver, your authorized representative, and your care team;
Coordinate referrals to healthcare providers, sports medicine clinics, emergency care, or other appropriate services;
Document consent, opt-in, opt-out, and communication preferences;
Provide appointment reminders, patient care updates, and follow-up instructions;
Maintain records required for clinical, operational, legal, security, compliance, or billing purposes;
Detect, prevent, and respond to security incidents, fraud, misuse, or unauthorized access;
Improve the safety, usability, reliability, and performance of our Services;
Comply with applicable laws, regulations, contracts, and legal process.
We do not use patient care text messaging for unrelated advertising or marketing.

3. SMS/Text Messaging
If you consent to receive text messages from Mye Health, we may send you messages related to your concussion hotline request and patient care coordination. These messages may include secure intake links, identity and consent forms, concussion red-flag screening links, appointment scheduling, visit reminders, patient care updates, and follow-up instructions.

Message frequency may vary, up to 7 messages per week. Message and data rates may apply. You may reply HELP for help or STOP to opt out.

Opting out of text messages may limit our ability to send timely scheduling links, reminders, intake forms, or follow-up instructions by SMS. Even if you opt out of SMS, we may still communicate with you through other permitted methods, such as phone, patient portal, email, or through your healthcare provider, as applicable.

We do not sell or share your mobile phone number for third-party marketing purposes.

4. How We Share Information
We may share information as necessary to provide the Services, coordinate care, comply with law, and operate our business. We may share information with:

Healthcare providers, sports medicine clinics, athletic trainers, physicians, nurses, care coordinators, or other care team members involved in your care;
Emergency services or appropriate medical personnel when needed for safety, urgent care, or emergency evaluation;
Parents, guardians, caregivers, or authorized representatives, when permitted by law and applicable consent;
Service providers and technology vendors that help us operate the Services, such as SMS, phone, video visit, scheduling, patient portal, cloud hosting, security, analytics, and support vendors;
Health plans, billing partners, or claims processors when needed for payment or coverage-related activities;
Legal, compliance, accounting, security, or professional advisors;
Government authorities, regulators, courts, or law enforcement when required or permitted by law;
A successor organization in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to applicable privacy and legal requirements.
When we work with vendors that handle health information on our behalf, we require appropriate contractual safeguards, which may include business associate agreements where required by HIPAA.

5. HIPAA and Healthcare Privacy
When Mye Health acts as a business associate or subcontractor business associate to a HIPAA-covered healthcare provider, clinic, health plan, or other business associate, we use and disclose PHI only as permitted by our applicable business associate agreements and HIPAA.

When Mye Health provides Services directly to you outside of a HIPAA-covered relationship, certain information may not be PHI under HIPAA, but we still treat health-related information with care and apply privacy and security safeguards.

If you receive care from a healthcare provider or clinic, that provider or clinic may have its own Notice of Privacy Practices that explains how it uses and discloses your PHI. This Privacy Policy does not replace the Notice of Privacy Practices of your healthcare provider or clinic.

6. Your Choices and Rights
Depending on where you live, the nature of your relationship with Mye Health, and applicable law, you may have rights to:

Request access to certain information we maintain about you;
Request correction of inaccurate information;
Request deletion of certain information, subject to legal, clinical, contractual, and recordkeeping requirements;
Opt out of SMS/text messages by replying STOP;
Request that we limit certain communications;
Ask questions about our privacy practices;
File a privacy complaint with us.
If your information is PHI maintained by a HIPAA-covered provider, your HIPAA rights may include the right to access, amend, receive an accounting of certain disclosures, request restrictions, request confidential communications, and receive a copy of the provider’s Notice of Privacy Practices. Some of these rights may need to be exercised directly with the healthcare provider or clinic responsible for your care.

7. Data Security
We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, or destruction. These safeguards may include access controls, encryption, audit logging, vendor security review, workforce training, and policies for handling health information.

No method of transmission or storage is completely secure. We cannot guarantee that information will be completely protected from unauthorized access, security incidents, or other risks.

8. Data Retention
We retain information for as long as reasonably necessary to provide the Services, support care coordination, comply with legal and contractual obligations, resolve disputes, maintain records, enforce agreements, and support security and audit requirements.

Retention periods may vary based on the type of information, applicable law, healthcare provider requirements, and whether the information is part of a clinical, billing, legal, or operational record.

9. Cookies and Website Technologies
Our website and portal may use cookies, log files, and similar technologies to operate the Services, maintain security, remember preferences, understand usage, and improve performance.

We do not knowingly use patient health information collected through the concussion hotline for third-party advertising or behavioral advertising.

10. Children and Minors
The Services may be used for minors with involvement of a parent, guardian, caregiver, healthcare provider, or other authorized adult, as permitted by law. If you are a parent or guardian and believe a child has provided information to us without appropriate authorization, please contact us.

11. Emergency and Safety Disclosures
If information you provide suggests a medical emergency, serious safety risk, abuse, neglect, or other situation where disclosure is required or permitted by law, we may share information with emergency responders, healthcare providers, caregivers, public authorities, or others as appropriate to protect health and safety.

12. Third-Party Services
The Services may include links to third-party websites, platforms, forms, portals, scheduling tools, video services, or healthcare providers. We are not responsible for the privacy practices of third parties that we do not control. Please review their privacy policies and terms.

13. State Privacy Rights
Some state privacy laws may provide residents with additional rights regarding personal information or consumer health data. These rights may include the right to access, correct, delete, or receive information about certain disclosures.

We will respond to applicable privacy requests as required by law. Some requests may be limited where information is governed by HIPAA, maintained for healthcare, legal, security, or compliance purposes, or controlled by a healthcare provider or clinic.

14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated version will be posted on our website with a new “Last Updated” date. Your continued use of the Services after an update means that the updated Privacy Policy applies to your use of the Services.
